Release and Indemnification
As the User, you understand that TutorsAndServices.com (the “Company”) is not an architectural or engineering firm. While the Company does provide software tutoring and drawings for architects, engineers, and others, we do not stamp drawings. User acknowledges that all Projects, Drawings, Depictions, and Designs (collectively, the “Work Product”) created through your use of TutorsAndServices.com (the “Company”) services (collectively, the “Services”), whether created individually by or collaboratively with a Company Service Provider, is Work Product created for ideation, conceptualization, and artistic visual design purposes only, and the User agrees that User shall not use such Work Product for engineering, construction, structural design, or other architectural purposes without additional review and stamping by a licensed engineer and/or architect for use in compliance with any federal, state, or local laws applicable to your jurisdiction. User releases the Company from and further indemnifies the Company, its members, officers, employees, Service Providers, and owners from and against all claims and suits by User and/or third parties from damages, injuries to persons (including death), property damages losses, and expenses including court costs and reasonable attorney’s fees, arising out of, or resulting from, the Company’s performances of its Services and User’s use of the Work Product, including all such causes of action based upon common, constitutional, or statutory law, or based in whole or in part, upon allegations of negligent or intentional acts on the part of the Company, its officers, employees, agents, subcontractors, licensees, or invitees.
Screenshare and Computer Access
While engaging in Work Sessions with Users, the Company typically utilizes screensharing programs (e.g. ZOOM.us) to actively observe User’s work and to demonstrate concepts and work tips. During these Sessions, User acknowledges and accepts full and complete responsibility for the security of User and User’s computer. User further agrees that, prior to such Work Sessions, User shall remove any private information from User’s computer desktop or any unprotected folder(s) accessible from User’s computer desktop. Such private information may include, but not be limited to, passwords, personal photos, financial, personal, or other sensitive or valuable information or files. Finally, User agrees that User should not leave the computer unattended and/or unsupervised at any time while engaged in an active screenshare session, and shall terminate any screenshare program, webcam use, and remote control program when leaving the computer unattended and/or unsupervised.
